The Chairman of The Verkhovna Rada of Ukraine resolved to forward the appeal of Yu.V.Lutsenko, Minister of Internal Affairs of Ukraine, on his resignation from the office of the Minister and documents of the Ministry of Foreign Affairs of Ukraine concerning the said matter to the Prime-Minister of Ukraine.
The said decision relies on the fact that only the Parliament, not the Chairman of The Verkhovna Rada of Ukraine, is authorized by the Constitution to accept resignation of members of the Government.
Moreover, the appeal of Yu.V.Lutsenko includes the proposal for the Chairman of The Verkhovna Rada of Ukraine to scrutinize the issue on resignation, the resignation itself being not declared. However, pursuant to Paragraph 4, Part 2 of Article 18 of the Law "On the Cabinet of Ministers", a member of the Cabinet of Ministers of Ukraine can be dismissed by The Verkhovna Rada of Ukraine, provided it accepts the resignation of the member of the Cabinet of Ministers of Ukraine on the grounds of a relevant appeal, submitted by the member.
Therefore, it is recommended that the Prime Minister of Ukraine immediately informs the Parliament about her attitude to the said matter and submits a relevant appeal to The Verkhovna Rada of Ukraine in compliance with the Law "On the Cabinet of Ministers of Ukraine" in case of agreement with the request of Yu.V.Lutsenko, Minister of Internal Affairs of Ukraine.
